对于药品知识产权的保护,欧美在专利制度的基础上推行了系列非专利制度,将改良药品纳入了知识产权保护中。对于渐进发展特性十分突出的中药而言,改良与创新同等重要,中药改良品种与创新品种都值得知识产权保护。中药品种保护制度具有发展为中药知识产权特有保护制度的潜力,以鼓励中药品种创新与改良为该制度的主要目标,在探讨中药知识产权保护机制时,应以利益平衡为准则,对中药创新品种予以"强"保护以达成"激励"效果,对中药改良品种予以"弱"保护以达成"促进"效果,最终形成促进中药产业健康发展并惠益社会大众的良好局面。

For the protection of pharmaceutical intellectual property rights,Europe and the United States have implemented a series of non-patent systems based on the patent system to include improved drugs in intellectual property protection.For traditional Chinese medicine (TCM),which have a very incremental nature,improvement and innovation are equally important.Both of the improved products and innovative products of TCM deserve intellectual property protection.The protection system for varieties of TCM has the potential to develop into a unique protection system for TCM intellectual property right.Encouraging innovation and improvement of TCM varieties are the main aims of the system.When discussing its protection mechanism,the innovative varieties of TCM should be"strongly "protected to achieve" incentive"effect,and the improved varieties of TCM should be"weakly "protected to achieve" promotion"effect according to the principle of benefit balance,finally to promote the healthy development of TCM industry and benefit the public.
