中药质量标志物（quality marker，Q-Marker）是为了提高中药质量控制水平而提出的概念。讨论中药Q-Marker相关知识产权的优势、中药Q-Marker适宜申请的专利类型。检索了近20年中药检测方法（质量控制方法）专利文献，对申请量变化趋势进行分析，并以三金制剂相关检测专利为例，探讨中药Q-Marker如何进行专利挖掘和专利布局。中药Q-Marker相关技术应积极申请专利保护，将有利于提升中药质量水平。

Quality marker (Q-Marker) of traditional Chinese medicine (TCM) was proposed to improve the quality of TCM. This paper discusses the advantages of intellectual property rights and the patent types about Q-Marker. The patent literatures of TCM detection method (quality control method) in recent 20 years were searched, and the tendency of application quantity had been analyzed. Taking the detection patents of Sanjin preparation as an example, this paper discussed how to mine and configurate the patents of Q-Marker of TCM. The related technology of TCM Q-Marker should be actively applied for patents. Protecting the intellectual property rights of Q-Marker of TCM is conducive to improve the quality of TCM.
