中医药地方规范性法律文件存有立法迟滞、名称多样、操作性不强等问题，有序推进中医药地方立法至关重要，是贯彻落实《中华人民共和国中医药法》（《中医药法》）的有效手段。地方推进中医药立法应立足《中医药法》的基本精神，了解地方中医药事业的发展需求，明晰《立法法》对地方立法权限及内容的相关规定，并可从规范地方规范性法律文件名称，发展地方特色及优势技术，细化地方扶持措施，扩充地方行政监督内容，健全中医药管理体制等着手，最终以形成既符合《中医药法》立法精神，又满足地方需求并突出地方特色的中医药地方规范性法律文件。

There are some problems in the local regulations of traditional Chinese medicine (TCM) such as lag, diversified names, lack of practicality, etc. The orderly advancement of local legislation of TCM is critical which will facilitate the implementation of the Law of the People's Republic of China on TCM (Law on TCM). Local legislation of TCM should base on the basic spirit of the Law on TCM, find out the practical needs for the development of local TCM, clarify the limitation and content of local legislative power in Legislation Law, and it can focus on the aspects of unifying the names of local regulations on TCM, sorting out and promoting TCM technologies with local characteristics, improving the safeguard measures, enhancing the local administrative supervision and management mechanism, improving the management system of TCM, etc. Eventually, the local regulations on TCM not only conform to the legislative spirit of Law on TCM, but also meet local needs and reflect local characteristics of TCM industry.
